Please read these Terms & Conditions carefully before purchasing. By completing a purchase, placing a bid, or taking possession of any item from What We Buyin, you agree to every term on this page without exception. If you do not agree, do not purchase.

What We Buyin does not accept returns or issue refunds under any circumstances. Once payment is submitted and/or an item is picked up, the transaction is complete and irrevocable. There are absolutely no exceptions to this policy — not for change of mind, condition disagreement, missing accessories, non-functionality, or any other reason.

All items are sold as-is, where-is, with no warranty, express or implied. The implied warranties of merchantability and fitness for a particular purpose are expressly disclaimed to the fullest extent permitted by Tennessee law.

2. What "Liquidation Merchandise" Means

What We Buyin sources and resells liquidation merchandise — goods that have been returned by consumers to retailers (including Amazon), overstock items, shelf-pull merchandise, refurbished products, open-box returns, and goods from insurance claims or warehouse auctions. This is not a traditional retail store, and liquidation goods are fundamentally different from new retail merchandise.

By purchasing from What We Buyin, you acknowledge and accept that any item may:

  • Have been previously owned, used, tested, opened, or returned by one or more prior consumers.
  • Show cosmetic damage including scratches, dents, cracks, scuffs, stains, or discoloration.
  • Be missing original packaging, manuals, cables, chargers, adapters, batteries, remote controls, or other accessories.
  • Have non-functional components, buttons, ports, features, or attachments.
  • Have been repaired, refurbished, or reconditioned — with or without original parts.
  • Contain incorrect model numbers, stickers, or labels from prior returns or mis-shipments.
  • Not power on, charge, connect, or operate as originally designed.
  • Have data, accounts, or personal information from previous owners not yet wiped (buyer is responsible for all data removal).
  • Be missing software licenses, activation codes, subscription entitlements, or digital content.
  • Smell of smoke, pet odors, cleaning agents, or other environmental exposure.

The listed item description and condition grade represent our best good-faith assessment at the time of listing. We cannot test every function of every item. A listing description that does not mention a specific defect does not mean that defect does not exist — it means it was not observed during our assessment. Buyer accepts this inherent uncertainty as part of purchasing liquidation goods.

3. Condition Grade Definitions

What We Buyin uses the following condition grades. These grades apply to the overall item appearance and known functional state at the time of listing. These grades are provided as general guidance only and do not constitute a guarantee of functionality, completeness, or fitness for any purpose.

NewItem is in original, unopened factory packaging with all original accessories and documentation. Has never been used or installed.
Like NewItem appears unused or minimally used. May have been opened for inspection. Original packaging may be missing or damaged. All major components present. No visible wear on the item itself.
GoodItem shows normal signs of prior use including light scratches, scuffs, or cosmetic marks. Fully functional or believed to be functional. Accessories may be missing. Packaging not included.
FairItem shows significant cosmetic wear, scratches, dents, or marks from prior use. May have minor functional issues. Accessories and packaging likely missing. Sold as-is for parts, repair, or reuse.
SalvageItem is non-functional, heavily damaged, incomplete, or intended for parts only. No warranty or functionality implied whatsoever. Purchase is entirely at buyer's own risk.

Condition grades are assigned at our sole discretion. Reasonable people may disagree on condition grading for liquidation goods. Any such disagreement does not constitute grounds for a return, refund, dispute, or chargeback.

4. Local Pickup Only — No Shipping

What We Buyin does NOT ship items. ALL items require in-person pickup at our location. There are no exceptions.

The following rules apply to all pickups:

  • Buyer is responsible for arranging pickup within the time window communicated at purchase. Failure to pick up within the required window may result in forfeiture of the item and payment without recourse.
  • Buyer must bring valid government-issued photo identification matching the name on the payment.
  • Buyer must bring confirmation of payment (email or order number).
  • Buyer is solely responsible for bringing adequate packing materials, boxes, straps, and a vehicle suitable for transporting the item. What We Buyin is not responsible for damage occurring during loading or transport.
  • For large or heavy items, buyer must bring sufficient assistance. What We Buyin staff are not required to assist with loading.

Taking physical possession of an item constitutes full and unconditional acceptance of that item in its received condition. Once an item leaves our premises, no claims of any kind — including but not limited to condition complaints, missing parts, or non-functionality — will be honored. The transaction is final at the moment of pickup.

5. Mandatory Pre-Pickup Inspection

Buyer has the right and the responsibility to inspect any item before taking possession. We encourage all buyers to thoroughly inspect items at pickup. If you are not satisfied with an item at the time of pickup, you must raise any concern with staff before the item leaves our premises.

Once an item is removed from our premises, inspection is deemed complete and the buyer has accepted the item unconditionally. What We Buyin will not accept any claim, complaint, dispute, or return request based on conditions that could have been discovered through inspection at the time of pickup.

By taking possession without raising a concern, buyer represents and warrants that:

  • Buyer had a reasonable opportunity to inspect the item prior to removal.
  • Buyer accepted the item in its observed condition.
  • Buyer waives all rights to claim the item was "not as described" after leaving the premises.
  • Buyer will not initiate any payment dispute, chargeback, or claim based on item condition.

6. Chargeback & Payment Dispute Policy

By completing a purchase, you explicitly agree not to initiate a chargeback, payment dispute, or reversal claim with your bank, credit card company, PayPal, Stripe, or any other payment processor.

You specifically agree that the following dispute claim types are inapplicable and fraudulent when raised against What We Buyin, given the nature of our business and these Terms:

  • "Item Not as Described"All items are sold as-is liquidation goods with disclosed condition grades. Buyer acknowledges items may have undisclosed defects. If buyer picked up the item, it was received.
  • "Item Not Received"What We Buyin sells LOCAL PICKUP ONLY. Items are not shipped. If you picked up your item, it was received. If you did not pick up your item, that is buyer's failure to collect, not non-delivery by the seller.
  • "Unauthorized Transaction"Purchases require active use of payment credentials, name, billing address, and CVV. If you processed the payment, you authorized the transaction. What We Buyin is not responsible for unauthorized use of your payment credentials by third parties.
  • "Significantly Not as Described"Condition variations are inherent to liquidation merchandise and are disclosed in these Terms. A condition dispute is not grounds for a SNAD claim when buyer accepted the item at pickup.
  • "Duplicate Charge"We process exactly one charge per order. Contact us at (615) 663-3639 before disputing an apparent duplicate.

Consequences of a fraudulent or invalid dispute:

  • What We Buyin will contest every chargeback and provide full documentation including purchase records, signed pickup confirmation, transaction logs, photos, and surveillance footage to the payment processor.
  • Buyer will be permanently banned from future purchases.
  • What We Buyin reserves the right to pursue civil legal action and recover the disputed amount plus chargeback fees, legal costs, and damages under Tennessee law.
  • Filing a false or misleading payment dispute may constitute fraud under 18 U.S.C. § 1343 and applicable Tennessee statutes.

7. Photo, Video & Recording Notice

Our premises may be monitored by video surveillance at all times for security and dispute-resolution purposes.

By entering our premises, you consent to being recorded by audio and/or video equipment. All transaction-related footage, photographs, and records are retained and may be used as evidence in any chargeback dispute, insurance claim, legal proceeding, or law enforcement inquiry.

What We Buyin may photograph or video-record items immediately before and after pickup, including the condition of the item and the customer taking possession. This documentation is retained as contemporaneous evidence of the transaction and item condition at handoff.

If a customer claims non-receipt or disputes the condition of an item after pickup, this footage and photographic record will be submitted to the payment processor, bank, and/or court as evidence of actual delivery and item condition.

8. Auction Terms

The following terms govern all auction-format listings offered by What We Buyin:

  • Placing a bid is a legally binding offer to purchase the item at the stated bid amount. By submitting a bid, you enter into a binding contract to pay that amount if you are the winning bidder.
  • The highest bid at auction close wins, subject to any stated reserve price. If a reserve price has not been met, What We Buyin reserves the right to decline the sale.
  • Bid amounts are final. Bids may not be retracted once submitted.
  • The winning bidder will be contacted within a reasonable time to arrange payment and pickup.
  • Payment must be completed within 48 hours of auction close, unless otherwise communicated. Failure to pay within the required window forfeits your winning bid, and you may be held liable for any difference between your bid and the subsequent resale price.
  • What We Buyin reserves the right to cancel, extend, or re-list any auction at any time before the auction ends for any reason.
  • Shill bidding or bid manipulation is prohibited and may be reported to law enforcement.
  • Auction items are subject to all other Terms & Conditions on this page, including the All Sales Final, Local Pickup Only, and Condition policies.

9. Payment Terms & No Cancellations

All payments are processed through Stripe's secure checkout platform. Payment is due in full at the time of purchase.

  • By clicking "Buy Now" or completing checkout, you confirm that you are authorized to use the payment method provided and that you agree to these Terms in full.
  • Orders may not be cancelled after payment is submitted. There are no cancellations.
  • Payment confirmation does not guarantee item availability in rare cases of simultaneous purchase or system error. In such cases, a full refund will be issued as our sole obligation.
  • Prices listed are in U.S. Dollars. Tennessee sales tax is collected where applicable.
  • What We Buyin does not store full credit card numbers. All payment data is handled by Stripe in compliance with PCI-DSS standards.
  • We reserve the right to refuse or cancel any order at our sole discretion, with full refund as the only remedy.

Submitting payment constitutes your electronic signature and agreement to these Terms & Conditions, the No Refund Policy, and all other provisions herein.

10. Limitation of Liability

To the maximum extent permitted by applicable law, What We Buyin's total liability to any buyer for any claim of any kind arising from a purchase shall not exceed the actual purchase price paid for the specific item giving rise to the claim.

What We Buyin expressly disclaims liability for:

  • Incidental, consequential, indirect, special, or punitive damages of any kind.
  • Loss of profits, revenue, data, or business opportunity.
  • Personal injury or property damage caused by use, misuse, or malfunction of a purchased item.
  • Any damage arising from a buyer's failure to inspect an item before removal from premises.
  • Incompatibility of items with buyer's intended use, systems, or requirements.
  • Any third-party claims arising from buyer's use or resale of purchased items.

Some jurisdictions do not allow limitation of implied warranties or consequential damages; in such cases the above limitations apply to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless What We Buyin, its owners, employees, and agents from and against any and all claims, damages, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use or misuse of any purchased item; (b) your breach of these Terms; (c) any fraudulent payment dispute or chargeback you initiate; or (d) any violation of applicable law in connection with your purchase or pickup.

12. Governing Law & Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or any purchase from What We Buyin shall be resolved exclusively in the state or federal courts located in Davidson County, Tennessee. You irrevocably consent to personal jurisdiction and venue in those courts and waive any objection to that venue.

Disputes must be raised within 30 days of the date of purchase. Any dispute not raised within 30 days is permanently waived and barred.

13. Prohibited Conduct

The following conduct is strictly prohibited and may result in permanent ban and legal action:

  • Filing a chargeback, payment dispute, or reversal after picking up and receiving an item.
  • Claiming non-receipt of an item that was physically picked up in person.
  • Misrepresenting the condition of an item in a dispute after accepting it at pickup.
  • Using another person's payment credentials without authorization.
  • Tampering with, switching, or substituting items during or after a pickup visit.
  • Threatening staff or leaving false reviews in connection with a denied return.
  • Attempting to resell items back to What We Buyin at inflated values.

14. Changes to These Terms

What We Buyin reserves the right to update or modify these Terms & Conditions at any time without prior notice. Changes are effective immediately upon posting to this page. The "Effective Date" at the top of this page reflects the date of the most recent update. Continued use of our website or continued purchases after changes are posted constitutes your acceptance of the updated Terms.

By purchasing from What We Buyin — whether online or in person — you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions in their entirety.

These terms exist to protect both parties. We are proud to offer great deals on liquidation merchandise, and we ask that buyers approach purchases with the understanding that liquidation goods carry inherent uncertainty. When in doubt, inspect before you commit. We appreciate your business.
